Terms & Conditions for the Arcade Hub & Arcadians
1.1 These terms and conditions ("Terms") govern your use of the online platform currently called Arcade Hub ("Arcade Hub") and set out the terms that govern how you may earn Arcadians that can be redeemed via the Arcade Hub. By using or accessing the Arcade Hub, including by setting up an account on Arcade Hub, or purchasing, earning, or using Arcadians, you agree to these Terms.
1.2 For the avoidance of doubt, these Terms do not apply to any bookings that you might make for activities taking place at F1® Arcade. For the terms and conditions that apply to bookings at F1 Arcade, please see the Booking Policy (available here).
1.3 These Terms should be read alongside:1.3.1 the Terms of Sale of Arcadians;1.3.2 the Booking Policy; and1.3.3 any specific terms and conditions applicable to a prize draw, Qualifying Purchase, Qualifying Activity and/or Reward (these terms are defined below).
1.4 Those terms, including these Terms, may have changed since you last reviewed them.
2.1 Arcade Hub is operated by Kindred Concepts Limited (a company registered in England and Wales under the company number 12815000). You can find everything you need to know about us, Arcadians and the Arcade Hub on our website (https://f1arcade.com/uk/hub) and in these Terms. If you have any questions or comments in respect of the Arcade Hub, Arcadians or F1 Arcade, you can contact us via our Customer Service Team (available here).
2.2 To contact you, Kindred will use the latest contact details that you have provided on your User Account on the Arcade Hub. Therefore, it is your responsibility to ensure that your up-to-date contact details, including e-mail address, is on the Arcade Hub.
3.1 You will be offered the opportunity to create an account for use in the Arcade Hub ("User Account") during the booking process and prior to beginning a race at any physical F1 Arcade.
3.2 In order to create an account you will need to provide your email address.
3.3 You can also set up a User Account by accessing the account set up page here.
4.1 In order to ensure that the Arcade Hub is safe, reliable and efficient for all users the following termsapply to your User Account:
4.1.1 You must only have one User Account and use your User Account for personal use only;
4.1.2 You must be 13 years or over to set up a User Account;
4.1.3 You must keep your User Account login details secure;
4.1.4 You must keep your contact details on the Arcade Hub up to date;
4.1.5 You must not use your User Account or the Arcade Hub in a way that is unlawful, misleading, discriminatory or fraudulent (or assists someone else in using the Arcade Hub in such a way) or in a way that infringes or violates someone else's rights, including theirintellectual property rights (such as by infringing another's copyright or trademark, or distributing or selling counterfeit or pirated goods);
4.1.6 You must not abuse the Arcade Hub in any way, for example by uploading viruses or malicious code or using the Arcade Hub to send spam or do anything else that could disable, overburden, interfere with or impair the proper working, integrity, operation or appearance of our services, systems or products; and
4.1.7 In addition to these Terms, you must comply with any additional terms and conditions (including the ones listed at Clause 1.3 of these Terms) that are made known to you.
5.1 We will give you the opportunity to earn Arcadians via a number of methods, which may (but will not always) include:
- (a) creating a profile on the Arcade Hub;
- (b) competing in a race at a physical F1 Arcade location; and
- (c) other loyalty metrics as determined by Kindred from time to time.
For the purpose of these Terms and for simplicity, we call the type of activities set out in Clause 5.1 "Qualifying Activities". Any Arcadian earnt via a Qualifying Activity is known as a “Earned Arcadian” We will give further information about what Qualifying Activities are currently active, and the number of Arcadians you will acquire for completing the particular Qualifying Activity, in the Arcade Hub.
5.2 We reserve the right to alter, remove, withdraw or cancel any Qualifying Activity at any point without prior written notice.
5.3 Any Arcadians acquired through a Qualifying Activity will appear in your User Account shortly after you have completed the relevant Qualifying Activity.
6.1 You can also purchase Arcadians via the Arcade Hub in bundles for a variety of prices. Please see the Terms of Sale for full terms and conditions relating to the purchase of Arcadians. For the purpose of these Terms and for simplicity, we call the purchase of Arcadians via the Arcade Hub "Qualifying Purchases".
6.2 Any Arcadians purchased through the Arcade Hub will appear in your User Account immediately.
7.1 You acknowledge and agree that the following terms apply to Arcadians:
- 7.1.1 Arcadians have no equivalent or representative cash value and will not be converted into or exchanged for cash or credit in any circumstances, with the exception, in limited circumstances, of Arcadians acquired through a Qualifying Purchase (for details of how you may get a refund for Arcadians acquired through a Qualifying Purchase please see the Terms of Sale);
- 7.1.2 you may only use Arcadians to redeem products and/or service that are displayed in the Arcade Hub ("Rewards);
- 7.1.3 you must not sell, assign or transfer Arcadians (or the benefit of such Arcadians) to any other person, including for payment or any other form of valuable consideration;
- 7.1.4 you are solely responsible for any tax you may incur arising out of acquiring or redeeming Arcadians and the use of Arcadians; and
- 7.1.5 you cannot earn Arcadians on Rewards that were acquired using Arcadians;
- 7.1.6 we may, at our sole discretion, limit the total number of Arcadians that can be earned through a particular Qualifying Activity; and
- 7.1.7 we may, at our sole discretion, limit the total number of Arcadians that can be held by a particular individual.
7.2 In addition, you acknowledge and agree that: (1) not all activities undertaken at a physical F1 Arcade location or on the Arcade Hub will be Qualifying Activities (or, where relevant, Qualifying Purchases); and (2) the number of Arcadians that can be acquired via Qualifying Activities will be determined by us in our sole discretion. You should therefore check, before undertaking a particular purchase or activity, to confirm whether you will earn Arcadians (and the amount of Arcadians you will earn). Information about Qualifying Activities and Qualifying Purchases is available on the Arcade Hub.
8.1 The balance of Earned Arcadians acquired between the 1st January 2023 until 11:59pm on the 31st of December 2023 for all users of the Arcade Hub will be reset to zero (0) at 11:59pm on the 31st of April 2024 (Balance Reset). This is a four (4) month extension from the original expiry on the 31st December 2023.
8.2 The balance of existing Purchased Arcadians acquired prior to 5 February 2024 will continue to be valid and therefore will not expire.
8.3 Any Arcadians purchased or earned through the Arcade Hub are valid for twelve (12) months from the date of when they were acquired. At the expiry date any expiring Arcadians shall be automatically removed from your User Account and will no longer be able to be used by you. We have no obligation to remind or inform you of an Arcadian’s expiry and it is your sole responsibility to ensure that you use all Arcadians prior to expiry.
9.1 You may use your Arcadians to redeem Rewards that may be advertised from time to time on the Arcade Hub and/or at any physical F1 Arcade location, provided that you have sufficient Arcadians in your User Account for your chosen Reward. We shall determine the range and quantity of Rewards available and may vary the range and quantity of Rewards (and number of Arcadians required to redeem any Reward) at any point.
9.2 Rewards which may be available from time to time include:
- 9.2.1 items which are listed on the Arcade Hub as available to be purchased in a physical F1 Arcade location for the amount of Arcadians specified. The Terms of Sale will apply to any purchase made using Arcadians in a physical F1 Arcade location; and
- 9.2.2 the opportunity to use Arcadians to purchase certain products and/or services that may be advertised on the Arcade Hub from time to time via "product drops" (Drops). These items will be available to qualifying users at a specified date and time for a limited time period (as advertised on the Arcade Hub). The Terms of Sale will apply to any purchase made via a Drop and further information about the relevant product and/or service and particular drop (including any entry mechanic and restrictions) will be available on the Arcade Hub.
9.3 We shall have the final decision in all matters relating to Rewards.
How we use any personal data you give us is set out in our Privacy Policy (available here).
We reserve the right to charge you for costs associated with the delivery of a Reward, such as postage and packaging.
In the unlikely event that the performance of one of our obligations (for example, delivery of a Reward to you) is delayed by an event outside our control (for example, natural disasters, inclement weather, fire, war or a pandemic) we will aim to contact you as soon as possible to let you know about the delay. In the event that there is a delay we will do what we can to reduce it. As long as we do this, we won't compensate you for the delay. However, if the delay is likely to be substantial you can contact us via our Customer Service Team (available here) to discuss potential options as to how we can resolve the delay.
13.1 We can end our contract with you, close your User Account and claim any compensation due to us if:
- 13.1.1 you don't make any payment to us when it's due (including any request from us to purchase Arcadians to clear a negative balance in your Arcade Hub account) and you still don't make payment within 7 days of our reminder that payment is due;
- 13.1.2 you don't, within a reasonable time of us asking for it, provide us with information, cooperation or access that we need to provide the Arcade Hub or your Arcadians to you (for example, your accurate email address or payment details);
- 13.1.3 you breach any of the restrictions set out in these Terms; or
- 13.1.4 you breach any applicable third party terms and conditions that may apply to a particular Reward.
13.2 You may close your User Account by contacting us via our Customer Service Team (available here).
13.3 If we end our contract with you or close your User Account any Earned Arcadians shall be null and void. We shall not be responsible for any loss, expense or damage you may suffer as a result of Earned Arcadians being lost. For the avoidance of doubt, we shall not be obliged to offer you a refund, cash alternative or replacement for any Earned Arcadians that become null and void.
14.1 We're not responsible for losses you suffer caused by us breaking these Terms unless the loss is:
- 14.1.1 Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
- 14.1.2 Caused by a delaying event outside our control. As long as we have taken the steps set out in the section We're not responsible for delays outside our control.
- 14.1.3 Caused by a third party. For example, we would not be responsible for any losses you may suffer if a third party used your User Account or Arcadians without your permission.
- 14.1.4 Avoidable. Something you could have avoided by taking reasonable action. For example, keeping your username and password for your User Account safe and secure.
- 14.1.5 A business loss. Relates to your use of the Arcade Hub or Arcadians for the purposes of your trade, business, craft or profession.
15.1 If you have an issue, we would appreciate it if you contacted us first and gave our team an opportunity to resolve any problems you have with us or the Arcade Hub by contacting our Customer Services Team here.
- 15.2 These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
16.1 We can transfer our contract with you, so that a different organisation is responsible for supplying the Arcade Hub, Arcadians and the Rewards. We'll tell you in writing if this happens and we'll ensure that the transfer won't affect your rights under the contract. If you're unhappy with the transfer you can contact us to end the contract within 7 days of us telling you about it.
16.2 You can only transfer your contract with us to someone else if we agree to this. We may not agree unless there are exceptional circumstances that mean you have to transfer your contract to someone else. Generally, we consider that your User Account and the Arcadians in your User Account are personal to you and should not be transferred to any other person.
16.3 These Terms are a contract between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
16.4 If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
16.5 Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn't mean we can't do it later.
